CORAM:
HON'BLE MR. JUSTICE ASHUTOSH KUMAR
O R D E R
% 01.11.2017 Crl.M.A.17799/2017 (extension of parole) in W.P.(CRL) 1866/2017 A prayer has been made for extending the period of parole for further period of two weeks as the petitioner, during the period of parole has suffered an accident and has broken his elbow. Learned counsel for the petitioner has drawn the attention of this court to the certificate annexed as Annexure A to the application which indicates that there has been a dislocation of the left elbow of the petitioner and a POP slab has been applied over it.
Though the injury is not of such kind which will prevent the petitioner from surrendering before the jail authorities but considering the fact that the petitioner has remained in jail for about 8 years and has displayed exemplary conduct, for which he has earned commendation from the jail administration, this court is inclined to extend the period of parole of the
petitioner for a further period of two weeks, to be counted from 02.11.2017, the date on which the parole period otherwise would have ended. The other conditions which have been imposed by order dated 19.09.2017 shall subsist. The petitioner shall positively surrender before the jail authorities on or before the end of the extended period of parole. The application is disposed of accordingly.
The order be communicated to the Superintendent of the concerned jail for information.
