At the outset learned counsel for respondent submits that in view of the judgment of the Supreme Court reported as AIR 2001 SC 1739 Vinoy Kumar Vs. State of U.P. and Ors. such a petition is not maintainable especially keeping in view the fact that this is not a PIL Court. At this stage, learned counsel for the petitioner submits that without prejudice to his rights and contentions he seeks permission of this Court to withdraw this petition. Permission granted.
