CORAM:
HON'BLE MR. JUSTICE JAYANT NATH
O R D E R
% 14.02.2017 1.
By the present transfer petition filed under Section 24 CPC, the petitioner seeks transfer of Civil Suit No. 206283/2016 pending in the court of Sh.Ajay Gulati, ADJ (South District) to the court of District Judge (South East District) and to club the same with Suit No. 67/2016 already pending adjudication before the District Judge (South East District). It is stated that both suits pertain to the same property and the property in question is located in Defence Colony and the appropriate court having territorial jurisdiction would be District Court (South East District). 2.
Learned counsel appearing for the respondents submits that he has no objection regarding the transfer of the matter but he submits that it would not be possible to club the two suits together as the nature of the relief TR.P.(C) 151/2016
claimed in the two suits is entirely different. 3.
Learned counsel for the petitioner has no objection if the suit is merely transferred.
4.
Accordingly, Civil Suit No. 206283/2016 titled as "Parvesh Kumar Bhasin vs. Jagdish Bhashin & Ors." pending in the court of Sh.Ajay Gulati, ADJ (South District) stands transferred to the court of District Judge (South East District). The said suit would be heard along with Suit No.67/2016 titled as "Parevesh Kumar Bhasin vs. Smt. Kamlesh Bhasin & Ors." which is already pending in the court of District Judge (South East District). The two suits may only be heard together. 5.
In view of the above, the petition stands disposed of. 6.
All pending applications, if any, also stand disposed of. JAYANT NATH, J FEBRUARY 14, 2017 rb TR.P.(C) 151/2016
