% 05.02.2019 After some hearing, the learned counsel for the petitioner, on instructions from the petitioner, who is present in person, concedes that the petitioner had moved another application under Section 311 of the Code of Criminal Procedure, 1973 (Cr.P.C.), which was dismissed by the Metropolitan Magistrate by order dated 11.01.2019. The counsel for the petitioner further submits that he is instructed to seek permission to withdraw the present petition, the petitioner reserving the right to assail the said last order dated 11.01.2019 before appropriate forum. The petition stands dismissed as withdrawn.
Application (Crl.M.A.18056/2016) having become infructuous stands disposed of accordingly.
