% 10.05.2018 An affidavit of service has been filed by counsel for the appellant giving the details of the appellant including his present address and mobile number. Counsel for the appellant has further stated that the appellant used to communicate with him by mobile no.9996594466 and subsequently met for a conference wherein the dismissal of the appeal was conveyed to him. As per office report, the notice was issued to the appellant on the address furnished in the affidavit. The same remains unserved with the report 'son of the appellant refused to receive the notice stating that his father is not living with him for the last three years and no one will receive the notice on his behalf'. In view of this, issue court notice to the SDM of the area concerned with the directions to trace the appellant and recover the costs of Rs.50,000/- (imposed vide orders of Hon'ble Court dated 04.08.2017), to deposit the same in the court. He is also directed to submit a report in this regard. Put up on 11.07.2018.
