O R D E R

% 02.08.2017 C.M. No.27359/2017 On the last date, the submissions and counter submissions were noted. The submission of the petitioner had been noted which was to the effect that notice under Section 13 (2) SARFAESI Act had not been sent at the correct address; the contention of the respondent bank was that that the petitioner had undertaken to pay Rs.6 lacs per month towards its outstanding dues. This undertaking of the petitioner had been reiterated in the last order and it had been directed that since no money had been paid up to 10.07.2017 (last order) inspite of the undertaking of the petitioner that he will pay Rs.6 lacs per month w.e.f. February, 2017, extension of two weeks had been granted to the petitioner to pay up the arrears.

This application, as per the petitioner, is a mercy petition wherein again he prays for some more time; his submission is that the arrears of Rs.6 lacs which are due; he had paid Rs.6 lacs and he is

ready to pay Rs.6 lacs, he seeks further time of four weeks to pay the balance amount of Rs.6 lacs.

This Court is not inclined to grant any further extension. This order will not come in the way of the respondent bank for taking proceedings (which have already been initiated) under the SARFAESI Act.

Application dismissed.
