% 28.11.2016 Present contempt petition has been filed alleging wilful disobedience of the order dated 26th November, 2015 passed in W.P.(C) No.1858/2014, whereby the petition was dismissed as not pressed with a liberty to make a representation to the respondent with regard to setting aside the order of punishment of dismissal to compulsory retirement on the ground of his unblemished past record and the acute hardship faced by him at the time of transfer when his parents were bed ridden.
Learned counsel for the petitioner states that petitioner's representation has not been disposed of till date. However, this Court finds that no time frame had been stipulated by the Division Bench in the order dated 26th November, 2015. Consequently, this Court is of the view that no case of contempt is made out.
However as prayed for, the petitioner is given liberty to file an application for clarification/direction before the same Division Bench. With the aforesaid liberty, present contempt petition is dismissed.
