% 13.02.2017 By the present petition the petitioner seeks quashing of FIR No. 78/2009 under Sections 363 IPC registered at PS Burari, Delhi on the complaint of Respondent No.2 and the proceedings pursuant thereto on the ground that the parties have settled the matter. Learned APP for the State on instructions from Investigating Officer submits that in the above-noted FIR petitioner is the only accused, respondent No.2 the complainant and respondent No.3 his minor daughter at the time of incident who is major now, the victim. She states that no other person is involved.

Respondent No. 2 the father of respondent No.3 and respondent No.3 who is now a major are present in Court and are identified by the Investigating Officer. They state that they have settled the matter with the CRL.M.C. 4332/2016

petitioners vide memorandum of understanding dated 5th November, 2016 and in view thereof they do not wish to pursue the above-noted FIR and the proceedings pursuant thereto as both the parties i.e. petitioner and respondent No.3 are now well-settled in their family lives. Petitioner who is present in Court and is identified by the learned counsel affirm the statement of respondent No.2 and 3 and state that he will give no cause of grievance to them in future. Considering the nature of allegations and the fact that parties have settled the matter and no useful purpose would be served in continuing with the above-noted FIR, rather the same would be an abuse of the process of the Court and there is no legal impediment in quashing the above-noted FIR, this Court deems it fit to quash the above-noted FIR and the proceedings pursuant thereto.

Consequently, FIR No. 78/2009 under Sections 363 IPC registered at PS Burari, Delhi and proceedings pursuant thereto are hereby quashed. Parties have signed this order sheet in acknowledgment of their statements made before this Court.

The petition is disposed of. Order dasti.
