CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 21.11.2016 On the oral prayer made by learned counsel for petitioner, Goldy @ Gurvinder Pal, resident of 8/2, Block-41, First Floor, Singh Sabha Road, Shakti Nagar, Delhi is impleaded as respondent no.3. Amended memo of parties be filed during course of the day.

Petitioner and respondent nos.2 & 3 are living in the same vicinity. In fact, respondent no.3 is living in the same building; whereas respondent no.2 is living about 200 metres away from the house of respondent no.2. Petitioner and respondent nos.2 & 3 are known to each other. Present FIR No.337/2016 was registered on the complaint of respondent no.2 at police

station Roop Nagar under Sections 323/354/506/34 IPC. It is noted that on the complaint of wife of petitioner, a cross FIR No.347/2016 under Sections 354/509/323/34 IPC was registered against the husband of respondent no.2, namely, Ajit Singh and other relatives namely, Sunit Pal Singh and Jujhar Singh. Petitioner on the one side and respondent no.2 on the other side have settled their disputes vide a compromise deed dated 18th November, 2016. Respondent no.2 is present in Court and submits that in view of the settlement, she is not willing to pursue FIR any further against petitioner and respondent no.3.

Keeping in mind the facts that a quarrel took place between the neighbours resulting in the lodging of cross FIRs and now the parties have settled disputes, I am of the view that no fruitful purpose would be served to keep the criminal proceedings, which are at the investigation stage, pending. Accordingly, FIR No.337/2016 registered on the complaint of respondent no.2 at police station Roop Nagar under Sections 323/354/506/34 IPC is quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
