% 20.12.2016 Counter-affidavit has not been filed. Mr. C.M. Goyal, learned counsel for the respondent has filed a copy of the counter-affidavit today in the Court. Same is taken on record. He points out to Para 7 of the counteraffidavit to contend that in so far as Prayer 'a' of the writ petition for grant of affiliation is concerned, same was considered by the respondent in its meeting held on 15th December, 2016 and the affiliation has been granted to the petitioner for the next academic session. He also states that the relevant order shall be communicated to the petitioner within one week. The said statement is taken on record.

In so far as Prayer 'b' of the petition is concerned, same cannot be granted in view of the judgment of this Court in the cases being W.P.(C) No. 9444/2016, Samrat Ashok Private ITI v. Directorate General of Training

(DGT) and W.P.(C) No. 9711/2016 Kalam Private ITI & Ors. v. Director General of Training (DGT) on 6th December, 2016. In view of the statement made by Mr. C.M. Goyal, Adv., Mr. Sanjay Sharawat, learned counsel for the petitioner seeks to withdraw the present petition.
