O R D E R

% 13.03.2019 After some hearing, the petitioner submitted that given the fact that the contentions raised give rise to question of facts which cannot be properly and effectively addressed in the proceedings under Section 482 Cr.P.C., he may be permitted to withdraw the present petition and urge the same in the inquiry to be held in the proceedings taken out by the respondent under Protection of Women from Domestic Violence Act, 2005 before the Magistrate. During the course of hearing, it was informed that the Metropolitan Magistrate has since stayed the proceedings in the said case sine die, presumably on account of the file of the case having been requisitioned by this court for purposes of the petition in hand. The proceedings in the said case stand revived, the order adjourning the same sine die being vacated.

CRL.M.C. 4789/2016

The parties are directed to appear before the Metropolitan Magistrate on 15th April, 2019.

The petition is dismissed as withdrawn. Trial court record shall be returned forthwith.
