The petitioner has filed the instant application under Section 438 Cr.P.C. seeking anticipatory bail in FIR No.222/2017, under Section 354/354-B/509/34 IPC, registered at PS Jafrabad. 2.

On 17th July, 2017, following order was passed by this Court:- '1.

By way of this application filed under Section 438 read with Section 482 Cr.P.C. the petitioner is praying for grant of anticipatory bail in FIR No.222/2017, under Section 354/354B/509/34 IPC, registered at PS Jafrabad. 2.

Detailed status report has been filed by the State in respect of the alleged assault on the police officers with photographs.

Learned counsel for the petitioner submits that even as per FIR, by the time the complainant Fahima called the PCR, the present petitioner had already left the spot. The subsequent incident with the police officer has allegedly taken place when the petitioner was not present and in respect of that incident, allegations are against his brother Shakeel @ Lambu is named.

Learned counsel for the petitioner further submits that though his brother Shakeel @ Lambu is BC of the area, the petitioner was never involved in any criminal case and has clean antecedents.

Considering the facts and circumstances of the case, the petitioner is directed to join the investigation as and when required by the IO/SHO concerned and also to provide his contact number to the IO concerned to facilitate communication for the purpose of joining the investigation. 6.

Re-notify for 14th August, 2017. Till next date of hearing, no coercive steps shall be taken against the applicant/petitioner.

It is submitted by learned APP for the State that the petitioner has joined the investigation and co-operated in the same and that his custodial interrogation is not required 4.

Keeping in view the role attributed to the present petitioner and that he has joined the investigation and his custodial interrogation is not required, it is directed that in the event of arrest, the petitioner be released on bail on his furnishing personal bond in the sum of ₹50,000/- with one surety in the like amount to the satisfaction of IO/SHO concerned. However, the petitioner is directed to join the investigation as and when required by the IO/SHO concerned.

As prayed, copy of the order be given dasti to learned counsel for the parties.
