% 02.02.2018 Learned counsel appearing on behalf of the parties invite our attention to a Memorandum of Understanding/Agreement dated 20th November, 2017, entered into by and between them before the Court of Ms. Savita Rao, ASJ, Saket Court, New Delhi and urge that the present appeal be disposed of, in terms thereof. It has further been brought to our notice that in terms of the said Memorandum of Understanding/Agreement, a sum of Rs.4,25,000/- (Four Lakh Twenty Five Thousand only) has already been paid to the appellant by the respondent. The only remaining condition that needs to be complied with is the withdrawal of the present appeal on behalf of the appellant.

Mr. Raj Mohan Gupta, learned counsel appearing on behalf of the appellant seeks leave to withdraw this appeal. In view of the foregoing, the appeal is dismissed as withdrawn and disposed of accordingly. Pending application also stands disposed of.
