% 06.09.2017 Petition relates to the alleged unauthorised creation of an exchange on the terrace and unauthorised use of basement of the property bearing no. B-106, Basement, Niti Bagh, New Delhi. During the course of hearing, ld. counsel for the respondent no.3 submits that against the sealing order dated 20.07.2017 passed under Section 345A of the DMC Act, the respondent has preferred an appeal and certain injunction order has come to be passed by Ld. AT, MCD. As regards another order under Section 345A passed on the same day i.e. 20.07.2017, respondent no.4 is also said to have approached AT, MCD and undertaken to remove its paraphernalia on

the terrace of the said property bearing no. B-106, Basement, Niti Bagh, New Delhi.

In the given factual conspectus, which is not in dispute, nothing survives in the instant petition and the same is disposed off accordingly. Should the petitioner find any fresh cause of action having arisen, petitioner would be at liberty to approach this Court afresh.
