% 27.02.2017 I.A. 2369/2017 (to take on record the settlement arrived at the Mediation Centre on behalf of plaintiff D-1, 2, 3 & 5) The plaintiff has arrived at a settlement with defendants No.1,2,3 and 5 vide settlement dated 12.01.2017, copy of which is placed on record. It is submitted by the plaintiff that the suit may be disposed of in terms of this settlement qua defendants 1,2,3 and 5 and she wants to withdraw her suit qua defendants 4 and 6. In view of the submissions of the learned counsel for the plaintiff, the suit against defendants No. 1,2,3 and 5 stand disposed of in terms of settlement dated 12.01.2017 and the suit against defendants 4 and 6 stand dismissed as withdrawn. Learned counsel for the plaintiff makes a request that in terms of Section 16 of Court-fees Act read with Section 89 of CPC, a
certificate for refund of court fee be issued in favour of the plaintiff. Since the matter stands settled before Delhi High Court Mediation and Conciliation Centre, a certificate of refund of court fee in terms of Section 16 of Court-fees Act read with Section 89 of CPC shall be issued in favour of the plaintiff.
All the pending applications also stand disposed of. The dates already fixed in the matter stand cancelled. DEEPA SHARMA, J FEBRUARY 27, 2017 bg
