% 19.03.2019 After some hearing, the learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition assailing the view taken by the Sub-Divisional Magistrate in proceedings taken out under Section 145 of the Code of Criminal Procedure, 1973, which has been upheld by the Court of Sessions in C.R. No.55902/2016, the petitioner reserving the right to approach the Civil Court for appropriate remedies. The petition and pending application are dismissed as withdrawn.
