BAIL APPLN. 2448/2016 Issue notice. Notice is accepted on behalf of the State. The petitioner has preferred this bail application to seek regular bail under Section 439 Cr PC in case FIR No.780/2016 registered under Section 363/370A/372/373/343/376/323/506/34 IPC. The petitioner has been in judicial custody since 04.09.2016. Ms. Kolluru states that the charge sheet has been filed under Section 365/366/368/370/370A/376/323/343/506 IPC.

As far as the petitioner is concerned, his alleged role is that he paid Rs.1 lakh to procure the complainant/ prosecutrix and he got married to her. The girl was rescued from the custody of the petitioner. Learned APP has pointed out that the girl, though a major, was a Muslim girl by religion. However, she was shown to be a Hindu girl and her name was changed to Pooja and shown as the daughter of Rambir, who is an associate of the petitioner and thus the petitioner would have been well aware of the fact that the girl was not a Hindu girl named Pooja. The statement of the girl made under Section 164 Cr PC has been read out. From the statement, it appears that the marriage took place in the presence of the local guardian of the girl in question, whom she addressed her as nanny.

Since the charge sheet stands filed, no useful purpose would be served in detaining the petitioner in custody any further during the pendency of the appeal. Accordingly, the petitioner is directed to be released on bail upon his furnishing personal bond with one surety in the sum of Rs.20,000/- to the satisfaction of the Trial Court. This is further subject to the condition that he shall not coerce/influence the complainant or her relatives. He shall provide his mobile phone number, which shall be kept in working condition at all times and shall not change the same without prior intimation to the court.

The application stands disposed of. Dasti.
