% 17.05.2018 After some hearing the counsel for the petitioner submits that he may be permitted to withdraw the present petition and the application filed therewith and instead approach the Rent Control Tribunal by a review petition against the judgment dated 27.02.2017 in appeal (RCA 362/2016) in as much as the delay in payment of deposit of rent for the months of February 2011, May 2011, August 2011, March 2012 and May 2013, as noted in the order dated 22.10.2016 of the Rent Controller in the case (RC/ARC-813/2016) has escaped its attention and consideration.

The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed granted.
