% 04.09.2017 C.M. No.46916/2016 (Condonation of delay in filing appeal) By this application the appellant seeks condonation of delay of 8 months in filing the appeal. The only explanation given by the appellant in para 3 of his application is that the appellant was seriously ill and was suffering with acute depression as he was very shocked after getting the trial court judgment from 15.03.2016 to 26.10.2016 and due to that the appellant could not file the present RFA within stipulated period.
The explanation given by the appellant does not satisfy the court for condoning the delay in filing the appeal. Accordingly, in the
facts and circumstances of the present case and for the lack of explanation for delay in filing the appeal, the application is dismissed. Application stands disposed of.
R.F.A. No. 997/2016 Consequent to dismissal of the application for seeking condonation of delay (C.M.No. 46916/2016), the appeal is hereby dismissed being barred by limitation.
