O R D E R

% 30.11.2018 At the outset, learned counsel for the plaintiffs states that a provisional liquidator has been appointed qua defendant no. 2. He does not wish to press the present suit qua defendant no.2. Accordingly, defendant no. 2 is deleted from the array of parties. Let an amended memo of parties be filed by the plaintiff within one week.

Today, Ms. Sucharu Garg, Advocate enters appearance on behalf of defendant no. 1. She has handed over her vakalatnama, which is taken on record.

It is pertinent to mention that present suit has been filed for permanent injunction restraining infringement of trade mark, rendition of accounts, dilution, delivery up etc.

Ms. Sucharu Garg, learned counsel for defendant no. 1-manufacturer states that the defendant no. 1 has no objection if the present suit is decreed in accordance with paragraph 32 (i) & (ii) of the plaint. In view the aforesaid undertaking, learned counsel for the plaintiff does not wish to press for any other or further relief. The statement and undertaking given by learned counsel for the defendant no. 1 is accepted by this Court and defendant no. 1 is held bound by the same.

Consequently, present suit is decreed in accordance with paragraph 32 (i) and (ii) of the plaint. Registry is directed to prepare a decree sheet accordingly. Accordingly, present suit and pending application stand disposed of.
