The present petition is filed under Section 11 of the Arbitration & Conciliation Act for appointment of an Arbitrator in terms of the Lease Agreement executed upon between the parties.

It is the case of the petitioner that Smt. Pushpa Bhatia, mother of the petitioner, entered into a lease agreement in respect of the property bearing No.8, Khampur ,Village, G.T.Karnal Road, Delhi measuring 850 sq.ft. An addendum agreement was also executed on 08.01.2011. 3.

As per the petitioner, the respondent company is making repeated defaults in making payment. Clause G of the lease agreement contains an arbitration clause.

The learned counsel appearing for the respondent company enters appearance.

She submits that she has no objection to appointment of an arbitrator.

Accordingly, the matter is referred to the Delhi International Arbitration Centre ('DIAC'). The DIAC shall appoint an Arbitrator in accordance with the provisions of the Act. The fees and other condition of the learned Arbitrator shall be in terms of the Rules of the Delhi International Arbitration Centre.

The petition is accordingly disposed of.
