% 25.04.2018 I.A. No. 5633/2018 (under Order 23 Rule 3 CPC, filed by plaintiff and D-1 and D-2) and CS(OS) 327/2017 1.

By this application filed under Order 23 Rule 3 CPC plaintiff and defendant nos. 1 and 2 seek to record the compromise between them whereby plaintiff does not seek any rights in the suit property qua his share and that said share would in fact vest with the defendant nos. 1 and 2.

Counsel appears for defendant nos. 3 to 5 and states that defendant nos. 3 to 5 have no claim in the suit property. CS(OS) 327/2017

Accordingly, this application and the suit are disposed of without passing any decree in view of the compromise by recording that the defendant nos. 1 and 2 would be the joint owners of the suit property being ground floor of plot no. 29 (admeasuring 867 sq, yards), NH-III, Lajpat Nagar, New Delhi.
