BAIL APPLN. 2419/2016 1.

By the present petition, the petitioner seeks anticipatory bail in case FIR No. 645/2016 under Sections 308/34 IPC registered at PS Neb Sarai, Delhi on the complaint of one Amarjeet.

The allegations in the FIR are that on 7th August, 2016 at around 10.15 PM the complainant had parked his motorcycle in front of his house whereafter Aamir @ Bhuri, the petitioner Salman, Sahil, Dabloo brother of BAIL APPLN. 2419/2016

Aamir and Vicky brother of Salman, who were the local residents of JJ Camp, Tigri, came there and an altercation took place over parking of the motorcycle in the street. Later all the accused started bearing the complainant and it is alleged that Aamir @ Bhuri hit the complainant Amarjeet on his head by a stone due to which blood oozed out. 3.

As per the MLC, Amarjeet received a laceration over the left side scalp 3 x .5 cms which was opined to be simple in nature which injury has been attributed to Aamir @ Bhuri.

Considering the role assigned to the petitioner and the fact that bail has already been granted to Aamir @ Bhuri by the learned Trial Court, this Court deems it fit to grant anticipatory bail to the petitioner. It is, therefore, directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned, further subject to the condition that he will join the investigation as and when directed by the Investigating Officer and will not leave the country without prior permission of the Court concerned. In case of any change in the residential address of the petitioner, the same will be intimated to the concerned court by way of an affidavit. 5.

Petition is disposed of. Order dasti.
