W.P.(CRL) 3370/2016 It is submitted that marriage of petitioner no. 1 and respondent no. 2 has been dissolved by a decree of divorce by mutual consent dated 16th September, 2016 passed by the Family Courts, Tis Hazari Courts, Delhi.

Respondent no. 2 is present in Court and has been identified by SI Ram Pal Singh, P.S. Nihal Vihar. She admits that matter has been settled between her and the petitioner no. 1 on 27th May, 2015. She further admits having received the entire settled amount from the petitioner no. 1. She submits that she has no objection in case FIR is quashed. Keeping in mind that settlement has been arrived at between the parties and that their marriage has already been dissolved, in my view, no fruitful purpose would be served in keeping them entangled in the criminal proceedings. Accordingly, in the interest of justice, FIR No. 754/2014 under Sections 498-A/406/34 IPC registered at Police Station Nihal Vihar and the consequent proceedings emanating therefrom are quashed.
