O R D E R

This order is in continuation of the earlier orders dated 4th October, 2018, 22nd November, 2018 and 11th December, 2018. 2.

The counsel for the plaintiff states that he has deposited the costs in terms of order dated 22nd November, 2018 and has furnished proof thereof to the Court Master.

The counsel for the defendant states that the costs have not been deposited.

The counsel for the plaintiff further states that a settlement has been arrived at before the Delhi Mediation Centre, Patiala House Courts, New Delhi and has handed over in the Court a photocopy of the proceedings dated 30th January, 2019 before the Delhi Mediation Centre, Patiala House Courts purporting to bear the signatures on behalf of the defendant Anumaya Interiors Pvt. Ltd. (AIPL) and Mr. Amit Katyal and their respective Advocates and the Advocate/Mediator.

The counsel for the plaintiff states that though in terms of the said settlement contained in the proceedings dated 30th January, 2019, this suit is to be withdrawn but since the proceedings in the Complaint Case No.23226/2016 of the Court of Ms. Neetu Sharma, Metropolitan Magistrate, Patiala House Courts, New Delhi are listed tomorrow and as per the proceedings dated 30th January, 2019, the parties have been directed to appear before that Court tomorrow, this suit will be withdrawn, after the proceedings tomorrow.

The counsel for the defendant AIPL, who is the complainant in Complaint Case No.23226/2016 states that in terms of the settlement aforesaid, the defendant AIPL will tomorrow withdraw the complaint case. 7.

In view of the aforesaid statement of the counsel for the defendant AIPL, there is no need to keep this suit pending. 8.

The suit is disposed of as settled, in terms of above, leaving the parties to bear their own costs.

A certificate entitling the plaintiff to get refund of court fees paid less Rs.20,000/- be issued and handed over to the counsel for the plaintiff. RAJIV SAHAI ENDLAW, J.
