1. The questions of law raised in the present appeal against the order of the learned Single Judge are left open for consideration in an appropriate case. The impugned order of the learned Single Judge will not constitute a precedent qua the said questions of law. This is because the Respondent is over 90 years old and the Court does not consider it appropriate to interfere with the merits of the case as far as he is concerned.

2. With the above observations, the appeal and the application are disposed of.
