CORAM:
HON'BLE MR. JUSTICE VALMIKI J. MEHTA
O R D E R
% 10.07.2017 1.
After arguments this appeal is disposed of as not pressed as it is stated that appellant proposes to move a review petition before the trial court inasmuch as the trial court has passed a preliminary decree in the suit for partition, but the appellant is a third party stranger in possession, and as against the appellant there is no decree for possession which is passed. 2.
In view of the above, while the appeal is disposed of as not pressed, however, liberty is granted to the appellant, in accordance with law, to file an application for review. The court below will consider the issue of RFA No.598/2017
condonation of delay liberally if there is any delay in filing of the review petition.
3.
Appeal is accordingly disposed of in terms of aforesaid observations.
