% 23.10.2017 Initially, FIR was registered under Sections 397/394/34 IPC.

Subsequently, FIR has been converted under Sections 395/120-B/34/412 IPC. Investigation is complete. Charges have already been framed and trial is underway.

Out of 34 witnesses, 26 witnesses have already been examined. Petitioner is in custody for the last 31⁄2 years. Learned APP submits that petitioner had conspired with co-accused persons and had passed on the information about the movement of complainant along with the jewellery, pursuant thereof dacoity was committed by the co-accused.

One diamond weighing 2.540 grams was

recovered from the petitioner. Petitioner is also involved in a similar case being FIR No. 272/2014 under Sections 392/397/34 IPC registered at Police Station Maurya Enclave.

Learned counsel for the petitioner submits that petitioner has not been identified by the complainant in Court.

Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
