W.P.(CRL) 3451/2016 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.531/2015, under Section 354A/509/506 IPC, registered at Police StationSouth Campus, Delhi and all the proceedings emanating therefrom. Learned counsel for the petitioner has submitted that the petitioner and the complainant are relatives and due to some misunderstanding arisen between the parties, FIR No. 531/2015, under Section 354A/509/506 IPC was registered at Police Station-South Campus, Delhi. He further submits that later on with the help/intervention of the friends and relatives of both
the sides, the matter has been amicably settled between the parties and nothing remains to be adjudicated further. Counsel further submits that the petitioner and the complainant want to lead a peaceful life and prays that the present FIR in question may be quashed.
Status report has been filed by the State. Respondent No.2/ complainant, Ms.Sarita Kumari is present in Court today and is identified by the Investigating Officer, SI Rekha of P.S. South Campus. Respondent No.2/complainant admits that she has amicably compromised/settled the matter with the petitioner vide settlement deed dated 25th October, 2016. She further submits that due to some misunderstanding the FIR was registered and now no dispute is left and further submits that the settlement/compromise has taken place voluntarily, without any force, pressure or coercion. She further submits that she has no objection if the present FIR is quashed against the petitioner. Accordingly, keeping in view the facts and circumstances of the case and the fact that the petitioner and the complainant are stated to be relatives, it is in their interest to live peacefully in the near future, I deem it appropriate to quash FIR No.531/2015, under Section 354A/509/506 IPC, registered at Police Station-South Campus, Delhi and all the proceedings emanating therefrom are quashed.
