This writ petition by way of public interest litigation has been filed seeking a direction to the respondents to remove the alleged unauthorized constructions in Ward No.89, Sadar Paharganj Zone, New Delhi. 2.

The petitioner had earlier filed W.P.(C) No.6607/2016 with the same prayer and the same was disposed of by order dated 01.08.2016 with a direction to the respondents to treat the writ petition as a representation and take appropriate action following due process of law within eight weeks, if the allegations are found to be true.

When the petition was listed on 09.12.2016, the learned counsel for North Delhi Municipal Corporation sought time to get instructions with regard to the steps taken in terms of the earlier order of this Court dated 01.08.2016 in W.P.(C) No.6607/2016.

Accordingly, a short affidavit dated 07.02.2017 has been filed on behalf of the North Delhi Municipal Corporation explaining the steps that

have already been taken with regard to various properties in Sadar Paharganj Zone and we have perused the same.

The petitioner is not present and no rejoinder is filed controverting the stand taken by North Delhi Municipal Corporation in its affidavit . 6.

In the circumstances, we do not think it is necessary to keep the petition pending any longer.
