O R D E R

% 16.12.2016 This is an application under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an arbitrator in place of late Justice S.K. Mahajan, a former Judge of this Court. It is stated that late Justice S.K. Mahajan (Retired) was appointed as an arbitrator by virtue of an order dated 19.12.2011 passed by this court. He has since expired and, therefore, an arbitrator is required to be appointed in his place. The respondent has no objection for the same.

Accordingly, Ms Justice Sunita Gupta (Retired) a former Judge of this Court is appointed as the sole arbitrator to adjudicate the disputes between the parties. The arbitrator shall continue the proceedings from the same stage as before late Justice S.K. Mahajan.

The parties shall take steps to take the records from the office of Late Justice S.K. Mahajan and file the same with Ms Justice Sunita Gupta (Retired). The parties are at liberty to approach Ms Justice Sunita Gupta (Retired) for further proceedings.

The petition is disposed of.
