After addressing arguments at some length, learned counsel for the appellant seeks leave to withdraw the present appeal while reserving the right of the appellant to seek legal recourse against the respondent No.2 in terms of the order dated 14.8.2015 passed in RFA 290/2009. 2.

Leave as prayed for, is granted. The appeal is disposed of along with the pending application.

As and when the appellant institutes a suit against the respondent No.2, the same shall be considered and decided by the concerned court in accordance with law.
