W.P.(CRL) 3394/2016 Marital discord between petitioner no.1 and respondent no.3 had led to the registration of present FIR No.0405/2015 under Sections 498A/406/506/34 IPC at police station Dwarka South on the complaint of respondent no.2.

Petitioner no.1 and respondent no.3 have settled their disputes amicably vide compromise deed dated 28th March, 2016. Marriage

between petitioner no.1 and respondent no.3 has already been dissolved by the decree of divorce by mutual consent on 15th October, 2016. Respondent no.2 is present in Court and has been identified by Inspector Adith Lily PS Dwarka South.

Respondent no.2 admits having settled the matter with petitioner no.1, on her own free will and without any undue force, coercion and undue influence. She submits that she has no objection, in case FIR is quashed.

Keeping in mind the facts that petitioner no.1 and respondent no.3 have settled their disputes amicably and marriage between them has already been dissolved by decree of divorce by mutual consent, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, FIR No.0405/2015 under Sections 498A/406/506/34 IPC registered at police station Dwarka South is quashed.
