% 01.02.2017 Present petition is filed under section 24 CPC seeking transfer of claim petition titled as Benzy Alexander & Ors. vs.Rajiv Anand & Ors.

being Suit No.64/2014 pending before the Motor Accidents Claim Tribunal, Karkardooma Courts, Delhi to the Presiding Officer, Motor Accidents Claim Tribunal, Saket Court, Delhi.

It is stated that connected matters arising out of the same accident are pending before the MACT, Saket Court, Delhi and it is in the interest of justice that the present petition is also transferred to the Saket Court to be heard alongwith other connected matters. It is stated that these claim petitions arise out of an accident that took place on 16.12.2013 on the highway between Delhi to Mathura.

Mr.V.Thomas, Advocate, enters appearance on behalf of respondents No.1 to 5/claimants and submits that he has no objection to the present petition. Other respondents are served but there is no appearance on their

behalf.

In my opinion, keeping in view the submissions made in the present petition it would be in the interest of justice that the aforesaid claim petition is transferred and heard by the concerned court at Saket. Petition is accordingly allowed. Parties to appear before the concerned MACT, Saket on 2.3.2017.
