O R D E R

% 10.03.2017 RC.REV. 569/2016 & CM No.44441/2016 (stay) I have heard learned counsel appearing for the petitioner. At this stage, learned counsel appearing for the petitioner submits that the petitioner would not like to contest the present Revision Petition in case one year's time is granted to the petitioner to vacate the tenanted property. Learned counsel appearing for the respondent submits on instructions from the respondent who is present in person in court that he has no objection to the said request of learned counsel for the petitioner. Let the petitioner No.1 file an affidavit to the court undertaking to vacate the tenanted premises and hand over the vacant physical possession of the tenanted property i.e. Shop situated at ground floor in property No.B323, J.J.Colony, Hastsal, Utam Nagar, New Delhi-110059 to the respondent within one year from today i.e. on or before 9.3.2018. In the undertaking the RC.REV.569/2016

petitioner shall also undertake to pay the agreed rent, electricity and water charges and not to induct any third party into the premises or cause any wilful damage to the property.

The aforesaid affidavit be filed within two weeks from today. Learned counsel for the respondent submits that in case the undertaking is filed within two weeks from today the petitioner shall not execute the eviction order till 9.3.2018.

In view of the above, learned counsel appearing for the petitioner submits that he does not wish to press the present revision petition. Revision Petition is disposed of. All pending applications, if any, also stand disposed of accordingly.
