IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(C) 11468/2016 BALRAJ ..... Petitioner Through:
Mr. U. Srivastava, Advocate versus GOVT. OF NCT OF DELHI AND ORS ..... Respondents Through:
Mr.

CORAM:

% 05.12.2016 1.
Having heard learned counsel for the parties, we are not inclined to interfere with the impugned order dated 6.9.2016 passed by the Principal Bench of the Central Administrative Tribunal, dismissing the application for condonation of delay for restoration of OA No.2553/2004. 2.
OA No.2553/2004 was dismissed in default and for non-prosecution on 3.8.2011.
3.
It is apparent to us that the petitioner had lost interest in the said OA, which pertains to a selection process and the selection list initially published on 13.10.2001 for the post of Fire Operators with the Delhi Fire Services. 4.
A restoration application was filed after a delay of more than three
years and nine months. Apparently, the interest of the petitioner got revived because OA No.426/2005, filed by one Manoj Kumar, was allowed by the Tribunal vide order dated 28.10.2014. We notice that the same order dismissed several applications for intervention on the ground of delay and laches.
5.
In the facts and circumstances of the present case, the petitioner has not been able to explain and justify the prolonged delay of more than three years and nine months in filing the restoration application. 6.
The writ petition is dismissed.
