CM(M) 2/2017 Petitioner before this Court is the estranged husband. It is stated that he has filed a petition for divorce against the wife under Section 13(1)(ia) of the Hindu Marriage Act. It is pointed out that issues have been framed way back on 22.07.2013. The matter has only progressed up to the stage of evidence; evidence has not yet been recorded. He prays that the matter be expedited. Record shows that in this intervening period (after framing of issues) an application under Section 24 of the Hindu Marriage Act has been filed by the respondent-wife which has been disposed of some times in the year 2015. This Court notes that on 22.8.2016, learned
Family Judge has noted that since interim maintenance has been granted to the respondent-wife under Section 125 Cr.P.C. it had fixed the next date for evidence of 21.12.2016. The next date now fixed before the Family Court Judge is 20.04.2017. The learned Family Judge will endeavour to dispose of this petition expeditiously; it will grant no unnecessary adjournment in the matter. With these directions petition is disposed of.
