O R D E R

% 21.02.2017 By the present petition the petitioners Gyan Singh and his son Balwant Singh seek anticipatory bail in case FIR No.1297/2015 under Sections 380/451/506/509/34 IPC registered at PS Safdarjung Enclave on the complaint of their tenant Smt. Guddi, pursuant to order passed by the learned Metropolitan Magistrate under Section 156(3) Cr.P.C. The allegations of the complainant in the FIR are that the petitioners and Rani, daughter of petitioner No.1 were staying in a portion of the same house i.e. H.No.32, Gali No.1, Krishana Nagar, Safdarjung Enclave, New Delhi and were harassing her and her family members by putting locks in the bathrooms. It is alleged that the petitioners broke the door of the bathroom, toilet and the roof and disconnected electricity. The petitioners BAIL APPLN. 2512/2016

have already joined the investigation and on the complaint of the petitioner FIR No.1296/2015 under Sections 389/506 IPC has already been registered pursuant to the orders of the learned Metropolitan Magistrate on 31st December, 2015.

Considering the facts and circumstances of the case, this Court deems it fit to grant anticipatory bail to the petitioners. It is therefore directed that in the event of arrest the petitioners be released on bail on their furnishing a personal bond in the sum of `25,000/- each with one surety each of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that they will join the investigation as and when directed and will not leave the country without the prior permission of the Court concerned.

Petition is disposed of. Order dasti.
