% 12.09.2018 I.A. 12068/2018 (u/O XXIII Rule 3 CPC) This is an application under Order XXIII Rule 3 filed by the Respondents, placing on record the settlement agreement dated 28th August, 2018 entered into between the parties. The same is allowed. I.A. is disposed of.
O.M.P. (COMM) 524/2016 The settlement agreement has been placed on record by the Delhi High Court Mediation & Conciliation Centre. The agreement has been signed by all the parties and their counsels. As per the agreement, the Petitioner has agreed to pay the Respondents, a sum total of Rs.3.9 crores. Upon the said payment being made, the Respondents would have no right, title or interest in any portion of the property bearing No.55, Poorvi Marg, Vasant Vihar, New Delhi-110057. The settlement terms are contained in
paragraph 6 of the agreement. The payment of a sum of Rs.70,00,000/- (Rupees Seventy Lakhs only), as per the agreement, has been made today. The demand drafts have been handed over to the Respondent, who is present in person. The receipt of the sum is duly acknowledged. Copies of the demand drafts for the sum of Rs.70 lakhs is taken on record. The Petitioner shall continue to make the payment as per the settlement agreement. The Petitioner is permitted to file certified copy of the agreement to sell and seek return of the original agreement to sell from the court record. Subject to the payments being made, the petition is disposed of as having been settled in terms of the settlement agreement. The settlement agreement shall operate as a decree, binding upon all the parties. All pending IAs are also disposed of.
