The petitioner has filed this petition under Section 482 Cr.P.C. praying for quashing of the FIR No.388/2015 under Sections 354/354D/506/509 IPC, registered at PS Haus Khaz, New Delhi on the basis of settlement .

On the last date of hearing i.e. 10th July, 2017, since complainant was not present the matter was adjourned for today and IO was directed to produce the complainant on the next date.

Today also complainant is not present. Learned counsel for the petitioner submits that complainant is out of station hence unable to come today.

Learned APP for the State/R-1 submits that complainant has been duly served for today but despite service she has not appeared. CRL.M.C. 2534/2017

Learned counsel for the petitioner submits that he may be permitted to withdraw this petition with liberty to file afresh as and when the complainant is available and ensuring her presence in the Court on the date when the matter is listed before the Court.

Accordingly, the petition is dismissed as withdrawn granting the liberty as prayed for.
