% 24.09.2015 The learned counsel for the respondent states that the fees of the Local Commissioner shall be absorbed by the respondent / plaintiff and would not form part of the costs of the suit. It is also agreed between the learned counsel for the parties that the place of recording of evidence by the Local Commissioner shall be Chamber No. 20, Block No. 1, Delhi High Court.

In view of the statements made by the learned counsel for the parties, the question of law, posed earlier, no longer arises for consideration by this court and we have not pronounced on the same.

The appeal stands disposed of.
