Mr. Vikram Veer Bhatnagar, respondent No.1 and his wife Mrs. Mamta Bhatnagar, respondent No.2 are present in person. They have been shown the original mediation settlement agreement dated 08.08.2017 placed before us and the signatures on all the pages as well as the enclosed site plan annexed thereto have been confirmed by them. Their signatures are identified by Ms. Kajal Sharma, learned counsel for the appellant.

Ms. Kajal Sharma also informs us that in terms of the settlement dated 08.08.2017, CS(OS) No.2731/2014 which was pending in this Court as well as CS No.84661/2016 which was pending before Ms. Priya Mehendra, Civil Judge, District Court FAO(OS) No.45/2017 Pg. 1 of 2

Saket have been withdrawn.

It is submitted by the learned counsel for the appellant as well as the respondents that the respondents have also received the Post Dated Cheque jointly of Rs.2 lakhs from the appellant in terms of settlement dated 08.08.2017.

In view thereof, nothing survives for adjudication in the present case.

This appeal is accordingly disposed of in terms of settlement dated 08.08.2017. All the parties shall remain bound by the terms of the settlement dated 08.08.2017.
