O R D E R

% 02.12.2016 CRL.M.C. 4441/2016 Learned counsel for the petitioner submits that the petitioner has deposited an amount of Rs.5 lacs with the Investigating Officer in FIR No.388/2011, P.S. Prashant Vihar and the same be handed over to him as he is required to deposit the same as the surety amount before the trial court. Learned APP for the State has filed status report. Investigating Officer is present and admits that the amount of Rs.5 lacs has been deposited with the Malkhana of P.S. Prashant Vihar in the said FIR. He further submits that the said amount has not been deposited as a case property.

In view of the submissions made by learned counsel for the petitioner, the said amount of Rs.5 lacs be returned to the petitioner herein i.e. the

rightful owner.

In view thereof, nothing remains to be adjudicated upon further in the matter. The present petition is disposed of accordingly. Copy of this order be given Dasti, as prayed. Crl. M.A. No.18542/2016 Dismissed as infructuous.
