CORAM:

HON'BLE MR. JUSTICE S.P.GARG

O R D E R

% 10.01.2017 1.

Present petition u/s 482 CRPC has been preferred by petitioner for quashing of FIR No. 164/2010 under Section 498A/406/34 IPC registered at Police Station Jamia Nagar. It is stated that the matter has been settled with the complainant/respondent no. 2 amicably. 2.

Respondent No.2/complainant is present before the Court along with her counsel. The Investigating Officer present in Court has identified her. I have inquired from the complainant whether the matter has been settled with the petitioner amicably without fear and pressure. She has informed that the matter has been settled without any fear or pressure and has no objection to the quashing of the

petition.

3.

The petition is supported by the affidavits of the parties. Memorandum of Understanding/Agreement dated 4.1.2016 arrived at between the parties is on record. Copy of the settlement agreement has been handed over by learned counsel for the petitioner to the learned counsel for respondent no. 2 in the Court today. The parties state that they shall abide by the terms and conditions of the settlement arrived at between them. It is further informed that divorce between the parties has been granted.

4.

Since the complainant/Respondent No.2 has voluntarily settled the dispute with the petitioner, no useful purpose will be served to continue with the proceedings. In the interest of justice and to put an end to the litigation and to enable the parties to settle in life after divorce, FIR No. 164/2010 under Section 498A/406/34 IPC registered at Police Station Jamia Nagar and all the proceedings emanating therefrom are quashed.

5.

The petition and pending application(s) stands disposed of. The parties shall abide by the terms and conditions of the settlement arrived at between them.
