% 26.02.2016 The learned counsel for the parties say that the matter has been settled between them. I am informed that settlement agreement dated 19.02.2016 (in short the agreement) has been executed between the parties. Though the settlement has not been filed, the learned counsel for the petitioner says that he would want to withdraw the petition with liberty to approach this court in case the settlement is breached. The captioned petition and the pending applications are, accordingly, dismissed as withdrawn. Liberty is, however, given to the petitioner to revive the petition in case there is a breach of the terms of settlement by the respondent, albeit, in accordance with law.
