Vide impugned order dated February 03, 2015 delay in filing written statement and along therewith counter claim by the respondent has been condoned by the learned Single Judge upon payment of costs in sum of `20,000/-.

The costs had to be paid within four weeks.

Albeit late, costs has been accepted by the appellant through the counsel on April 30, 2015 receipt whereof has been shown to us.

We accordingly dismissed the appeal for two reasons. Firstly costs having been accepted by the appellant and secondly the discretion exercised by the learned Single Judge is on sound principles. 4.

No costs.
