O R D E R

% 15.12.2016 W.P.(C) 11323/2016 The present petition has been filed by the petitioners with the following prayers:

(a) Pass appropriate writ order or direction thereby directing the Respondent No.3 i.e. SDM, South West District, Kapashera, New Delhi to decide the application for setting aside the ex-parte order dated 24.06.2010 passed by SDM/RA, Najafgarh by which the land of the petitioners have been illegally vested in the Gram Sabha Goela Khurd;

(b) Pass appropriate writ order or direction thereby directing the SDM/RA, South West District, Kapashera, New Delhi to immediately take up the stay application filed by the petitioners and to pass necessary orders on the same and also direct the respondents to maintain status quo as on the date at the site; and

(c) Pass such other order or orders as this Hon'ble Court may deem just and proper in the facts and circumstances of the case.

On the last date of hearing, Mr. Avtar Singh, Adv. had appeared for the respondents and accepted notice on the petition and sought two weeks time to take instructions and file affidavit. Today, he states that as per his instructions, the application filed by the petitioners on 21st November, 2016 for setting aside the ex-parte order dated 24th June, 2010 shall be decided within four weeks from today. The said statement is taken on record. In view of the submission made by learned counsel for the respondents, nothing survives in the present petition. Same is disposed of as such.
