% 11.07.2017 The short issue which arises for consideration is whether the petitioner has the prescribed height of 167 centimetres. It is the case of the respondents that his height as measured by the Medical Board at the time of his medical fitness for appointment to the post of Junior Assistant, (Fire Service) is 166.4 centimetres.
Mr. Digvijay Rai, learned counsel appearing for the respondent states the respondent is agreeable for the matter being referred to the Medical Board to be constituted by the Medical Superintendent, Dr. Ram Manohar Lohia Hospital, New Delhi. Mr. Sourabh Ahuja, learned counsel for the petitioner has no objection. Accordingly, Medical Superintendent, Dr. Ram Manohar Lohia Hospital, New Delhi to constitute a Medical Board within four weeks from the date of receipt of the copy of this order to measure the height of the petitioner. The date and time so fixed by the Medical Board shall be intimated to the petitioner and the respondent to enable the
petitioner and the representative of respondents are present on the date and time fixed by the Medical Board. The Medical Board shall submit its report to the respondents within one week thereafter. It is agreed by the counsel for the parties that they shall abide by the outcome of the Medical Board. In view of the above the present petition is disposed of. CM No. 23416/2017 Dismissed as infructuous.
A copy of this order be sent to the Medical Superintendent, Dr. Ram Manohar Lohia Hospital, New Delhi along with the copy of the petition. V. KAMESWAR RAO, J JULY 11, 2017/jg
