Fresh Status Report has been filed by the ACP, AHTU, Crime Branch stating inter alia that the FSL result of the polygraph examination conducted on the petitioner reveals that there is no deceptive response in respect of issues No.(i) and (ii) as mentioned in para 12 of the report. It is further stated that on 23.01.2019, the petitioner had informed the police that his brother had made a telephone call on the mobile phone of his cousin, Gautam from a particular mobile number based in Etawah, U.P. On contacting the said number, one Mr.Bhagwan Singh had stated that a person had requested him to permit him to make a call and thereafter, he had left from there. On 30.01.2019 a team was sent to Etawah, U.P. for making a search of the petitioner's brother and the person from whose mobile phone the petitioner's cousin had received the call was also interrogated. He had identified the petitioner's brother from the W.P.(CRL) 3133/2018 P-1/2
photos shown to him but had said that he had made a call from his phone for about 30 seconds and then left in the direction of the bus stand. About 22 hotels have been checked in Etawah, U.P. but there is no entry in the name of petitioner's missing brother. Copies of Hue and Cry notices were also distributed in all the hotels.
2.
In our opinion, Hue and Cry notices ought to have been pasted at the bus stands and railway stations as well. Learned counsel states that needful shall be done at the earliest.
3.
On 31.01.2019 raids were conducted at the residence of the petitioner's uncle and enquiries were made locally but no clue has been received about the missing person so far.
