% 16.07.2015 I.A.14041/2015 (FOR EARLY HEARING) It is submitted that parties have settled their disputes before the Mediation Centre, therefore, date fixed in the matter be preponed. Accordingly, date is preponed for today. Date fixed in the matter, that is, 03rd September, 2015 is cancelled.

CS(OS) 1844/2015 Parties have settled their disputes before the Delhi High Court Mediation and Conciliation Centre vide Settlement Agreement dated 13th July, 2015.

Photocopy of the Settlement Agreement has been placed on record.

Defendant, who is present in Court, admits that the settlement has been arrived at before the Mediation Centre and bears his signatures.

Settlement Agreement is marked as Mark 'C-1'. It is also admitted by learned counsel for parties that Mark 'C-1' has been signed by both the parties as well as by them.

Parties shall remain bound by the terms of settlement.

Accordingly, suit is disposed of in terms of Mark 'C-1'. It is agreed between the plaintiff and the defendant that possession of the suit property will be delivered on 17th July, 2015 at 2.00 pm at site by the defendant to plaintiff in the presence of a Local Commissioner, to be appointed by this Court.

Accordingly, Ms. Kohika, Advocate (Mobile No.9868913707) is appointed as Local Commissioner in whose presence possession shall be delivered by the defendant to plaintiff on 17th July, 2015 at 2.00 pm.

Fee of the Local Commissioner is fixed at `75,000/- to be paid by the plaintiff.

Since parties have settled their disputes through the process of Mediation, let court fee be refunded to the plaintiff and necessary certificate in this regard be issued by the Registry.

Copy of the order be given Dasti to both the parties under the signatures of Court Master.
